Guidance for recordal of Trademark assignment in Myanmar

The owner of trademark in Myanmar with fully protected rights in relation to the object specified in the contract can be assigned to other organizations or individuals. The trademark assignment in Myanmar must be registered and declare the assignment with the trademark registry office.

Under Myanmar’s legislation, the heirs of the trademark owner has the right to own and use the trademark.

1. Requirements:

(i) An original Power of Attorney (POA) in the name of Assignee, which must be executed by legal representative person of Assignee, then certified by a Notary Public, then legalized by the Myanmar Embassy or Consulate in country of the Assignee;

(ii) An original Power of Attorney in the name of Assignor, which must be executed by legal representative person of Assignor, then certified by a Notary Public, then legalized by the Myanmar Embassy or Consulate in country of the Assignor;

(iii) One original Deed of Trademark Assignments, which must be executed by legal representative person of Assignor and Assignee, then certified by a Notary Public (the same person, who signed on the POA is recommended);

Note the item “Signature of the witness”: Under current practice, trademark assignment in Myanmar is not expressly required the attendance of a witness and his signature, where it depends on case by case.

2. Cost for trademark assignment in Myanmar

The package cost including both official fees and all inclusive attorney’s fee and disbursements for the recordal of assignment for the trademark from the time of filing up to the obtaining the recordal of assignment.

3. Time frame

The average time from filing up to the recordal of trademark assignment in Myanmar will be about 2 – 3 months.

The assignment shall only valid after the declarations of assignment are certified by Myanmar’s trademark registry office.
